KT is willing to provide one round of comments on draft articles through peer review procedures. KT is content to leave a PI to decide when a paper is ready for publication. KT requires to receive a copy of all published articles which include data generated through research projects it has funded (either in paper or electronic form).
KT reserves the general right to publish information about the Project and the research results in order to discharge its own duty to ensure charitable funds are deployed for the public good. It may 'publish' interim and research project reports on its website but will always seek the permission of the PI in advance.
Any publication by each Party shall be at the Party's cost, including the cost of any copyright fees. However, PIs may apply to the Trust for funds to publish articles in journals which require fees from submitting authors. KT requires PIs seeking such funding to submit articles only to journals that use a peer review process. KT may reject the request for funding in this context if it considers the article to have significant weaknesses.
Each Party also undertakes to keep confidential any information concerning the business, affairs, directors or employees of the other Party that comes into its possession and, except with the prior written consent of the other Party, not to use such information for any purpose other than that for which it was provided.
This clause shall not restrict the use of any information that is in, or subsequently enters, the public domain, other than as a result of a breach of these obligations of confidentiality. It also does not restrict the disclosure of information which is required to be disclosed by law.
